1. Agreement to Terms

By accessing or using Sikho.ai ("Platform," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and Sikho.ai. Your use of the Platform is also governed by our Privacy Policy.

2. Eligibility

• You must be at least 13 years old to create an account.
• Users between 13-18 years old should have parental consent.
• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You may not create multiple accounts or share your account with others.

3. User Accounts

3.1 Account Registration

You may create an account by:

• Email and password registration
• Google Sign-In (OAuth)

3.2 Account Security

• You are responsible for all activities under your account.
• Notify us immediately at security@sikho.ai of any unauthorized access.
• We are not liable for losses due to unauthorized use of your account.

3.3 Account Termination

You may delete your account at any time from your dashboard. We may suspend or terminate your account for violations of these Terms.

4. Platform Services

4.1 Current Services (Free Access)

Sikho.ai currently provides free access to:

• AI-Generated Courses: Programming, business, creative, science, languages, health & fitness
• AI Tutor: Real-time AI-powered learning assistance
• Guru 1.1: Advanced AI learning companion
• Interactive Learning Tools: Code editors, assessments, progress tracking
• Community Features: Discussion forums and peer interaction
• Progress Tracking: Course completion, bookmarks, notes

4.2 Future Paid Services

When pricing is introduced, we will:

• Provide at least 30 days advance notice
• Update these Terms with payment and billing information
• May grandfather existing free users or offer special pricing
• Clearly communicate what remains free vs. paid

5. Acceptable Use Policy

5.1 Permitted Uses

You may use Sikho.ai for:

• Personal learning and skill development
• Accessing course materials and educational content
• Engaging with the AI Tutor and Guru features
• Participating in community discussions
• Completing assessments and projects

5.2 Prohibited Uses

You may NOT:

• Abuse AI Services: Excessive API calls, automated scraping, or system abuse
• Share Accounts: Share credentials or create accounts for others
• Redistribute Content: Copy, distribute, or resell course materials
• Reverse Engineer: Attempt to extract source code or platform logic
• Spam or Phish: Send unsolicited messages or fraudulent content
• Upload Malware: Introduce viruses, malware, or harmful code
• Impersonate: Pretend to be another person or entity
• Harass Others: Engage in bullying, hate speech, or offensive content
• Violate Laws: Use the Platform for illegal activities
• Scrape Data: Use automated tools to extract platform data

6. Intellectual Property Rights

6.1 Sikho.ai Content

All course materials, AI-generated content, platform code, design, and branding are owned by Sikho.ai or our licensors. You receive a limited, non-exclusive, non-transferable license to access and use the content for personal learning purposes only.

6.2 User-Generated Content

When you post in forums, create notes, or submit assignments:

• You retain ownership of your content
• You grant Sikho.ai a worldwide, royalty-free license to use, display, and distribute your content on the Platform
• You represent that your content does not violate any third-party rights
• We may remove content that violates these Terms or our Community Guidelines

6.3 Copyright Infringement

If you believe content on Sikho.ai infringes your copyright, please contact us at copyright@sikho.ai with:

• Description of the copyrighted work
• URL of the infringing content
• Your contact information
• Statement of good faith belief
• Statement under penalty of perjury

7. AI Services - Special Terms

7.1 AI Tutor and Guru

Our AI-powered features are provided "as is" with the following understanding:

• AI responses may contain errors or inaccuracies
• AI is a learning tool, not a replacement for professional instruction
• You are responsible for verifying information provided by AI
• AI interactions are processed by OpenRouter API (third-party service)
• Conversations are stored for your learning history

7.2 Fair Use of AI Services

• Do not abuse or overload AI services with excessive requests
• Do not attempt to extract or replicate AI model capabilities
• Use AI features responsibly and in good faith

8. Privacy and Data Protection

Your use of Sikho.ai is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

Key points:

• We collect account data, usage data, and AI interaction data
• Data is processed in accordance with GDPR and India DPDP Act 2023
• You have rights to access, correct, and delete your data
• We use cookies for authentication and functionality

9. Disclaimers and Limitations of Liability

9.1 "As Is" Service

Sikho.ai is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free service
• Security or freedom from viruses

9.2 Educational Content Disclaimer

• Courses are for educational purposes only
• We do not guarantee specific learning outcomes or career advancement
• Course content may become outdated
• Completion of courses does not constitute professional certification

9.3 Limitation of Liability

To the fullest extent permitted by law:

• Sikho.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid to Sikho.ai in the past 12 months (currently $0)
• We are not responsible for third-party content or services

10. Indemnification

You agree to indemnify and hold harmless Sikho.ai, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your user-generated content

11. Modifications to Service and Terms

11.1 Service Changes

We reserve the right to:

• Modify, suspend, or discontinue any part of the Platform
• Add or remove features
• Introduce paid services or subscription models
• Change pricing (with advance notice)

11.2 Terms Updates

We may update these Terms from time to time. Significant changes will be communicated via:

• Prominent notice on the Platform
• Updated "Last Updated" date

Continued use after changes constitutes acceptance of the updated Terms.

12. Termination

12.1 By You

You may stop using Sikho.ai and delete your account at any time.

We may suspend or terminate your account if:

• Your account is inactive for an extended period
• Required by law or legal process
• We discontinue the service

12.3 Effect of Termination

• Your access to the Platform will cease

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles.

13.2 Dispute Resolution

2. Mediation: If informal resolution fails, both parties agree to attempt mediation

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Sikho.ai.

14.2 Severability

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign these Terms. Sikho.ai may assign these Terms in connection with a merger, acquisition, or sale of assets.

14.5 Force Majeure

Sikho.ai shall not be liable for failure to perform due to circumstances beyond our reasonable control.
